PART 1: TERMS & CONDITIONS

These terms govern the use of the Make Arts marketplace operated by Mak and Arts Ltd (Company No: 16991466), registered at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ.

1. The Marketplace
Make Arts is a platform where independent Sellers list handmade goods for Buyers to purchase. We provide the technology to connect you but are not the manufacturer or owner of the goods sold.

2. Fees and Payments

• Fees: We charge a total fee of 10% on every successful sale. This is split between our platform commission (7%) and Stripe’s processing fees (approximately 3%).
• Payment Provider: All payments are handled securely by Stripe. By using our site, you also agree to Stripe’s terms.
• Payouts: Sellers will typically receive their funds 7 days after a successful transaction, subject to security checks.

3. Selling & Shipping

• Sellers must accurately describe their items and only list handmade goods.
• Shipping is handled entirely by the Seller. Sellers must dispatch items within their stated timeframe.
• Sellers are responsible for ensuring items reach the Buyer safely. We recommend using tracked shipping for high-value items.

4. Disputes & Returns

• If there is a problem, Buyers and Sellers must first attempt to resolve it between themselves.
• If a resolution cannot be reached within 14 days, Make Arts Ltd may step in to mediate, though we do not guarantee a specific outcome.
• Returns for “change of mind” are subject to the individual Seller’s policy, but all Sellers must comply with UK Consumer Rights laws regarding faulty or “not as described” goods.

5. Rules of Conduct

• Users must be 18+ to create an account.
• No illegal, infringing, or prohibited items may be listed.
• Copyright and Trademark responsibility lies solely with the Seller.

PART 2: PRIVACY POLICY (GDPR COMPLIANT)

We respect your privacy and process your data in accordance with UK GDPR.

1. Data We Collect
To run this marketplace, we collect:

• Identity Data: Name and date of birth (to verify you are 18+).
• Contact Data: Email address and physical shipping/billing addresses.
• Transaction Data: Details of products bought/sold and payments made (processed via Stripe).

2. How We Use Your Data
We use your information to:

• Process your orders and facilitate shipping between Buyer and Seller.
• Pay Sellers their earnings.
• Send essential service updates (order confirmations, etc.).
• Comply with UK tax and legal obligations.

3. Third-Party Sharing
We do not sell your data. We only share it with essential partners:

• Stripe: To process your payments securely.
• Hostinger: Our website hosting provider.
• Sellers/Buyers: We share the necessary name and address details between the two parties of a transaction so the item can be shipped.

4. Your Rights

These terms and our privacy practices are governed by the laws of England and Wales.
